Terms of Service

These Terms of Service ("Terms") govern your use of brooksbrawn.com and the Brooks Brawn application (the "Service"), operated by Brooks Brawn ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts found to be in violation of this requirement.

2. Subscription and Billing

• The Service is offered at $25/month following a 7-day free trial.
• A valid payment method is required to start the free trial. You will not be charged until the trial period ends.
• Subscriptions automatically renew each month unless cancelled.
• You may cancel your subscription at any time using the cancellation option within the app. Upon cancellation, your account and all associated data will be permanently deleted.
• No refunds are issued for partial billing periods.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Share your account credentials with others
• Attempt to circumvent the subscription or authentication system
• Submit false, misleading, or inappropriate content including video submissions
• Use the Service in any way that could damage, disable, or impair it

4. Health and Fitness Disclaimer

The workout programs, coaching cues, and fitness content provided through the Service are for informational and educational purposes only. Brooks Brawn does not provide medical advice. Before starting any new exercise program, consult with a qualified healthcare provider, especially if you have any pre-existing medical conditions or injuries.

You assume full responsibility for any injury, health consequence, or loss arising from your use of or reliance on any information provided through the Service. Brooks Brawn, its founders, coaches, and affiliates are not liable for any injury or damages resulting from use of the Service.

5. User-Submitted Content

By submitting video content or meet results to the Service, you grant Brooks Brawn a non-exclusive license to display that content within the app (e.g., on the leaderboard). You retain ownership of your content. We reserve the right to remove any submitted content at our discretion.

6. Intellectual Property

All content within the Service — including workout programming, coaching cues, and app design — is the property of Brooks Brawn. You may not reproduce, distribute, or create derivative works from this content without our express written permission.

7. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time via the cancellation feature in the app.

8. Limitation of Liability

To the fullest extent permitted by law, Brooks Brawn shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
